These Terms of Use (“Terms”) govern your use of the HomeWise mobile application and related services provided by Alavue (“HomeWise,” “we,” “us,” or “our”).
By downloading, accessing, creating an account for, or using HomeWise, you agree to these Terms. If you do not agree to these Terms, do not use HomeWise.
HomeWise is a digital home binder designed to help users organize information about their homes, rooms, home systems, household items, maintenance information, service providers, documents, photos, and related records.
HomeWise is an organizational tool. We do not guarantee that information entered into the app is complete, accurate, current, or suitable for any particular purpose.
You must be legally permitted to enter into these Terms in the jurisdiction where you live.
HomeWise is not directed to children under 13. If you are under the age required to enter into a binding agreement in your jurisdiction, you may use HomeWise only with the involvement and permission of a parent or legal guardian.
Some HomeWise features require an account.
You are responsible for:
Providing accurate account information.
Maintaining control of your account and authentication credentials.
Keeping your email account secure.
Activities conducted through your HomeWise account.
Promptly notifying us if you believe your account has been accessed without authorization.
You may not impersonate another person, create an account using information you are not authorized to use, or attempt to gain unauthorized access to another user's account.
You retain ownership of information and files you enter or upload to HomeWise, including home information, notes, photos, documents, receipts, manuals, and other content (“User Content”).
You grant us a limited license to host, store, process, transmit, copy, display, and otherwise use User Content only as reasonably necessary to operate, maintain, secure, and provide HomeWise.
This license does not transfer ownership of your User Content to us.
You are responsible for ensuring that you have the right to upload, store, or share any User Content you place in HomeWise.
HomeWise may allow you to share access to a home binder with other users.
If you invite another person to a home binder, that person may be able to view, add, edit, or otherwise interact with information in that home depending on the permissions provided by HomeWise.
You are responsible for deciding whom you authorize to access a shared home.
Do not share a home binder with someone you do not trust.
Changes made by authorized users of a shared home may affect information available to other members of that home.
The owner of a home binder may have additional administrative rights, including the ability to manage members or delete the home.
You may use HomeWise only for lawful purposes.
You may not:
Use HomeWise to violate any applicable law or regulation.
Access or attempt to access another user's account or data without authorization.
Interfere with or disrupt HomeWise, its servers, networks, or security features.
Attempt to bypass usage limits, subscription restrictions, access controls, or security measures.
Upload malicious software, harmful code, or files intended to damage or disrupt systems.
Use automated systems to scrape, extract, or excessively access HomeWise.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of HomeWise except where applicable law expressly permits it.
Use HomeWise to infringe another person's intellectual-property, privacy, or other legal rights.
Use HomeWise for fraudulent, deceptive, abusive, or unlawful activity.
We may restrict or terminate access when reasonably necessary to protect HomeWise, our users, or third parties
HomeWise may offer both free and paid features.
Features, limits, storage allowances, sharing capabilities, home limits, and other functionality may vary by plan.
The features included in a particular plan are those described in the app at the time of purchase or subscription.
We may add, modify, replace, or discontinue features over time. We will not intentionally remove a material paid benefit during an active paid subscription without providing appropriate notice or otherwise complying with applicable law.
HomeWise may offer automatically renewing Premium subscriptions.
Subscription pricing, billing frequency, included features, and other material terms will be displayed before you complete a purchase.
Subscriptions purchased through the Apple App Store or Google Play are billed to your account with the applicable store.
Unless canceled, an automatically renewing subscription may renew at the end of each billing period according to the terms displayed when you subscribed.
HomeWise does not directly receive or store your full payment-card information for purchases processed by Apple or Google.
Subscription eligibility and access may be verified using RevenueCat or other services used to manage subscription entitlements.
You may manage or cancel a subscription through the store where you purchased it.
Canceling a subscription generally prevents future renewal but does not necessarily terminate your Premium access immediately. You may continue to have access through the remainder of the paid billing period, subject to the rules of the applicable app store and applicable law.
Deleting your HomeWise account does not automatically cancel a subscription purchased through Apple or Google.
If you delete your HomeWise account and do not want future subscription charges, you should also cancel the subscription through the applicable app store.
HomeWise will provide access within the app to appropriate subscription-management options.
Google specifically requires an easy-to-use cancellation method in the app for subscriptions sold through Google Play.
Purchases made through the Apple App Store or Google Play are subject to the applicable store's purchase and refund rules, as well as applicable law.
Eligibility for a refund may vary depending on the circumstances, timing of the request, country or region, and the platform through which the purchase was made.
Where permitted, we may also assist with or issue refunds in accordance with our policies and applicable law.
Google's current policies specifically permit developers to issue refunds and note that cancellation ordinarily does not itself create a refund for the current billing period.
Some HomeWise plans may include limits on homes, storage, uploads, or other resources.
You are responsible for remaining within the limits applicable to your plan.
If your subscription ends or your account changes to a plan with lower limits, some features or stored content may become unavailable.
Where applicable, we may provide a reasonable opportunity to restore a subscription, remove content, download eligible data, or otherwise bring the account within applicable plan limits before permanent deletion of excess stored content.
Specific storage and plan limits may be described in the app and may change as HomeWise evolves.
We use reasonable efforts to maintain HomeWise and protect stored information, but no online service can guarantee uninterrupted availability or permanent storage.
HomeWise may occasionally be unavailable because of maintenance, software updates, network failures, service-provider outages, security incidents, or circumstances beyond our control.
You should retain independent copies of documents or information that are especially important to you.
If your HomeWise plan includes export functionality, we recommend periodically exporting a copy of your HomeWise data as an additional backup, particularly before making significant changes to your account or stored information.
HomeWise should not be used as the sole repository for irreplaceable records.
HomeWise helps users organize information. It is not a substitute for professional advice, inspection, maintenance, repair, legal advice, insurance advice, engineering advice, or safety advice.
Information stored in HomeWise may have been entered by you or another authorized user and may be incomplete or inaccurate.
You are responsible for verifying information before relying on it for repairs, maintenance, purchases, insurance claims, property transactions, safety decisions, or other significant decisions.
HomeWise may allow users to save links to product manuals, manufacturers, service providers, websites, or other third-party resources.
We do not control third-party websites or services and are not responsible for their content, availability, security, accuracy, or privacy practices.
A link to a third-party service does not necessarily mean that HomeWise endorses or guarantees that service.
HomeWise, including its software, design, branding, logos, interface, graphics, and other materials provided by us, is owned by or licensed to Alavue and is protected by applicable intellectual-property laws.
Except for the limited right to use HomeWise under these Terms, no ownership rights in HomeWise are transferred to you.
“HomeWise,” the HomeWise design, and related branding may not be copied or used in a manner that suggests sponsorship, endorsement, or affiliation without permission.
If you voluntarily provide suggestions, ideas, or feedback about HomeWise, you permit us to use that feedback without restriction or compensation to improve, develop, market, or
operate HomeWise.
This does not give us ownership of your User Content.
You may stop using HomeWise at any time.
You may request deletion of your account through the account-deletion process provided by HomeWise.
We may suspend or terminate access if we reasonably believe:
You materially violated these Terms.
Your account is being used fraudulently or unlawfully.
Your activity creates a security risk.
Suspension is necessary to protect other users or our systems.
We are required to do so by law.
Where appropriate, we may provide notice or an opportunity to correct a violation before termination.
Termination does not eliminate obligations that by their nature should survive termination, including ownership provisions, payment obligations already incurred, disclaimers, and limitations of liability.
You may request deletion of your HomeWise account through the app or through the external deletion process made available by HomeWise.
Account deletion may permanently remove your personal account information and associated User Content, subject to information we are permitted or required to retain.
If you own a shared home, HomeWise may require you to address ownership or shared access before deleting the account so that data belonging to or used by other authorized users is handled appropriately.
Account deletion and subscription cancellation are separate actions.

HomeWise will evolve over time.
We may update the app, change its design, add or remove features, adjust technical requirements, or change plan offerings.
We may discontinue HomeWise or a material portion of the service. If a discontinuation materially affects paid users, we will provide notice where reasonably practicable and comply with applicable legal obligations.
We may update these Terms to reflect changes in HomeWise, our business practices, technology, or applicable law.
When we make material changes, we will update the “Last Updated” date and may provide notice within the app or through another appropriate method.
Your continued use of HomeWise after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.
If applicable law requires affirmative consent to a change, we will request that consent.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEWISE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY BE DISCLAIMED BY LAW.
WE DO NOT WARRANT THAT HOMEWISE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT USER CONTENT WILL NEVER BE LOST.
Some jurisdictions do not permit certain warranty disclaimers, so some of these provisions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALAVUE AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO HOMEWISE.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS, PROPERTY DAMAGE RESULTING FROM RELIANCE ON STORED INFORMATION, OR LOSS RESULTING FROM INTERRUPTION OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO HOMEWISE WILL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID FOR HOMEWISE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
US $100.
Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Alavue and its affiliates, owners, employees, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:
Your unlawful use of HomeWise.
Your material violation of these Terms.
User Content you upload or share in violation of another person's rights.
Your unauthorized access to or misuse of another person's information.
This provision does not apply where prohibited by applicable law.
These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles, except to the extent applicable consumer-protection law requires otherwise.
Nothing in these Terms limits any consumer rights you may have under mandatory laws that apply where you live.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
The unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted.
If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
These Terms, together with the HomeWise Privacy Policy and any additional terms presented when purchasing or using a particular feature, constitute the agreement between you and Alavue regarding HomeWise.
For iOS users, Apple's applicable App Store terms and standard End User License Agreement may also apply. Apple provides its standard EULA automatically unless the developer substitutes a custom agreement.
For Android users, applicable Google Play terms also apply to purchases and use of Google Play service
